Terms and Conditions

The terms that govern your use of the Chic AI mobile application and its styling services.

Welcome to Chic AI! These Terms and Conditions (“Terms”) govern your use of the Chic AI mobile application (the “App”) operated by N&R Tech Labs, LLC a company located in 131 Continental Dr, Suite 305, Newark, Delaware having the registration number 30-1425874. By accessing or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

1. Acceptance of Terms

By creating an account, uploading content, or accessing the App, you agree to comply with and be legally bound by these Terms and our Privacy Policy. If you do not agree to these terms, you may not use the App.

2. Eligibility

You must be at least 13 years old to use Chic AI. If you are under 18, but in any way over 13, you may use the App only with the consent and supervision of a parent or legal guardian. By using Chic AI, you represent that you meet this age requirement.

3. User Accounts

  1. Registration: You may create an account using your email, Google, or Apple ID. You are responsible for maintaining the confidentiality of your login information.
  2. Account Security: You are responsible for all activities that occur under your account. Please do not share your password or account details with anyone. Notify us immediately if you suspect any unauthorized use.
  3. Account Termination: We reserve the right to suspend or terminate your access if you violate any part of these Terms, without any prior notice.

4. User-Generated Content

  1. Photo Uploads: The App allows you to upload images of your clothing. By uploading, you grant Chic AI a non-exclusive, royalty-free, worldwide license to use, store, share and in any way process the images solely for the purpose of providing AI-based style suggestions. Make sure that the images you upload do not contain private, sensitive, proprietary or confidential information.
  2. Content Ownership: You retain ownership of any photos or data you upload to Chic AI. We do not claim ownership of your personal wardrobe images, except for the rights stipulated in art. 4.1. above. In any case, please be advised that it is possible other users may copy and in any way use the photos you upload, and we cannot and do not have an obligation to oppose to such use, and, also, we cannot disclose to you personal information of other users, unless you have a court order or other similar decision issued by authorities who have the legal right to issue such decisions.
  3. Prohibited Content: You agree not to upload any offensive, inappropriate, or illegal content such as obscene or sexually explicit material, content that incites to violence, discrimination, proprietary information such as, but not limited to trademarks. Chic AI reserves the right to remove content that violates this clause. By uploading photos you agree and undertake that you are the rightful owner of those photos, and by using or uploading those photos you do not infringe the intellectual property rights or the privacy of any third party.

5. AI-Powered Style Suggestions

  1. AI Recommendations: Our AI will suggest outfit combinations based on your uploaded photos. While we aim to provide accurate and relevant suggestions, you acknowledge that the recommendations are based on machine learning and may not always meet your expectations.
  2. Explanations: Chic AI may offer simple explanations for why specific items are matched together, but these are for guidance purposes only.

6. Fashion Tips & Information

  1. Educational Content: Chic AI may offer general fashion tips and guidance for different styles (e.g., casual, formal, business). This information is provided for inspiration and guidance only and should not be seen as professional advice.
  2. No Guarantees: We do not guarantee that the fashion tips provided will result in any specific personal outcomes.

7. Payment & Subscriptions

  1. Subscription Services: Chic AI provides subscription-based access to premium features and AI-driven style suggestions. Subscription plans and pricing will be clearly displayed within the app before purchase.
  2. Billing: Payments are processed via your Apple App Store or Google Play Store account at the time of confirmation. You agree to the respective store’s billing terms, including automatic renewals, unless you disable auto-renew prior to the end of the current billing cycle.
  3. Automatic Renewal: Unless you cancel your subscription before the end of the billing period, your plan will automatically renew at the then-current price. You may manage or cancel your subscription directly through your App Store or Play Store account settings.
  4. No Refunds: All subscription purchases are final. By accessing Chic AI’s premium features, you acknowledge and agree that the services are considered fully delivered and consumed upon access. No refunds or partial credits will be issued for unused time, unless otherwise required by your app store’s specific policies or applicable law.
  5. EU Withdrawal Waiver: If you are located in the European Union, you acknowledge that Chic AI’s services qualify as digital content delivered immediately upon purchase. You expressly agree to waive your 14-day right of withdrawal under Article 16(m) of Directive 2011/83/EU by accessing the service.

8. User Responsibilities

  1. Appropriate Use: You agree to use Chic AI in compliance with all applicable laws and these Terms.
  2. Prohibited Activities: You agree not to:
    • Reverse-engineer, modify, or create derivative works of the App.
    • Use the App for unlawful purposes.
    • Exploit any vulnerabilities or security issues in the App.

9. Privacy

  1. Data Collection: We collect and process personal information in accordance with our Privacy Policy.
  2. Data Use: Data, including uploaded photos and usage analytics, is used to enhance and personalize your experience. Your images are processed solely to generate AI-based style suggestions.

10. Intellectual Property

  1. Ownership: All trademarks, logos, designs, and materials related to Chic AI are owned by N&R Tech Labs, LLC, a company located in 131 Continental Dr, Suite 305, Newark, Delaware, Identification number: 30-1425874. You may not use these elements without our prior written permission.
  2. License: You are granted a limited, non-exclusive, revocable license to use Chic AI for personal, non-commercial purposes only.

11. Disclaimer of Warranties

  1. Service As-Is: Chic AI is provided “as is” without warranties of any kind, either express or implied.
  2. AI Recommendations: AI-generated recommendations may not always meet user expectations or be error-free.
  3. No Guarantees: We do not guarantee that the App will be available at all times or free from errors, bugs, or interruptions.

12. Limitation of Liability

  1. No Liability: To the fullest extent permitted by law, Chic AI and NorSoft Development will not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the App.
  2. Maximum Liability: Our total liability for all claims related to the App is limited to the amount you paid for the token used for the provision of the specific services that led to the filing of the claim for damages.

13. Indemnification

You agree to indemnify and hold harmless N&R Tech Labs, LLC and its affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

14. Modifications & Updates

  1. Changes to the App: We may change, suspend, or discontinue any part of the App at any time without prior notice.
  2. Updates to Terms: We may update these Terms from time to time. If we do, we will notify you by updating the “Last Updated” date. Your continued use of the App after changes are made constitutes acceptance of the new Terms.

15. Termination

  1. Account Termination: We may terminate or suspend your access if you violate these Terms.
  2. Effect of Termination: Upon termination, your access to Chic AI and any unused tokens may be forfeited.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Delaware USA. We would like to understand and try to address your concerns prior to formal legal action. Before filing a claim against us, you agree to try to resolve the dispute informally by sending us notice at contact@chic-ai.com of your name, a description of the dispute, and the relief you seek. If we are unable to resolve a dispute within 60 days, you may bring a formal proceeding. Any statute of limitations will be tolled during the 60-day resolution process. If you reside in the EU, the European Commission provides for an online dispute resolution platform, which you can access at https://ec.europa.eu/consumers/odr.

By creating an account or using the Chic AI app, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

18. Refund Policy

  1. Final Sales: All payments made through Chic AI are non-refundable, including subscription fees. By completing a purchase, you agree that access to digital content is provided immediately and that you lose the right to withdraw once the service begins.
  2. No Refunds After Use: If you access any subscription feature, including generating style suggestions, viewing personalized outfits, or using premium fashion content, the service is deemed used. No refunds will be granted after access occurs, regardless of subscription status or usage duration.
  3. Dispute Resolution and Chargebacks: If you initiate a chargeback or payment dispute, we reserve the right to suspend or terminate your account and access to the Chic AI app until the matter is resolved. We may contest chargebacks directly with payment providers if services were accessed.
  4. App Store Policies: Your purchases and billing are subject to the policies of Apple App Store or Google Play Store. If you are entitled to a refund under their rules, you must request it through the relevant store.
